A Quality Response to Representations
Our client in Parkside first came to us with a big problem and didn’t now how to deal with it. They had just submitted a planning application for four terrace dwellings in Parkside. The problem was that the application was subject to public notification and received a total five (5) representations against the proposal!
The client activated CPD to review all representations and prepare a detailed response to representations as requested by the City of Unley’s development officer. In response a four page document was prepared in response to seven different points of contention. These issues were across various assessment points such as design, density, landscaping, vegetation, car parking (off and on street), traffic flow as well as demolition of the existing dwelling.
Our response was able to identify that the majority of the issues raised were not issues that were inconsistent with the requirement of the Planning and Design Code affecting this property. Although many were valid strategic issues for Council to deal with under seperate processes, issues such as traffic and parking in the locality were already prevalent and not exacerbated by the proposal. Therefore the response was able to strengthen the argument that the proposal sufficiently met the Planning and Design Code..

By providing the response to representations to CPD for review and response, our client was able to deal with the notification process efficiently and with no major roadblocks. The proposal went on to be approved under delegation by Councils Assessment Manager and the Planning Consent was issued to the client only a few days after the response was submitted. This mean’t the proposal was able to avoid going to a Council Assessment Panel meeting, where anything can happen!
